New Clubs Opening and Membership
Terms and Conditions

  1. Presale, founder, pre-opening, preview or any memberships are available to purchase in advance of club opening at corresponding rates remain at the business sole discretion and are a subject to change as per business decision of the Company.

  2. The rates are available and valid for one time purchase and any future renewals, upgrades or changes to the membership will follow in line with current at the time available rates.

  3. All standard Terms and Conditions apply prior to the club opening and once the club opens.

  4. Club opening dates are provisional and the actual opening date will be communicated to all customers that purchased this type of membership. All members choosing to join during the club pre-opening stage agree that no compensation applies for any reason whatsoever and that the actual official date will be communicated to them accordingly prior to the official gym opening date.

  5. Your membership will automatically get activated and start on the day that the club opens for business and will be valid for a specified period in line with the purchased membership, such as monthly or annually with the access rights specified at the time of selecting membership.

  6. No adjustments can be made to the membership start date and any members joining in the pre-opening stage agree to this condition.

  7. If a member wishes to upgrade their membership that was purchased during pre-opening of the club, they have to upgrade to current at the time rates. Pre-opening rates apply to specific periods only after which, the founder or pre-opening rates are not available to choose from.

  8. Lack of club usage or visit does not grant a refund, change of start date or any variation of compensation for any reason whatsoever.

  9. You have an option to upgrade your membership in line with current at the time available rates and change the membership by paying corresponding fees. The Terms and Conditions applicable to the newly chosen membership will apply.

  10. By purchasing or enrolling in the presale membership (the "Membership"), you consent to the Terms and Conditions, along with any additional terms that may apply to specific offers, services or products.

  11. For monthly rolling membership, first billing payment will be adjusted accordingly using the tokenized card you provided at the point of joining.

  12. All memberships purchased have corresponding Terms and Conditions, this applies to new joiners, re-joining members and renewals. The Membership Agreements are linked to the purchased membership and its term.

  13. If a member chooses to continue their membership by renewing, updated Terms and Conditions will apply to the new, renewed membership and its term.

MEMBERSHIP TERMS & CONDITIONS

The Membership Terms and Conditions mentioned herein shall form an integral part of the Membership Application & Agreement Form (MAAF) duly signed by the Member and shall be binding upon the Member. They shall govern the obligations and rights of FIT N GLAM LADIES GYM LLC.

DEFINITIONS

“Company” shall mean FitnGlam Ladies Gym LLC having its registered office at Al Ghurair Warehouses, Al Quoz, Dubai, UAE.

“Club” shall mean and include all branches of the Club operated by the Company depending on the category of the Membership.

“Club Staff” shall mean and include the Company, its directors, fitness professionals, employees and consultants.

“Club Tiers” define the access rights associated with the purchased Membership . The Tiers are a subject to change and new tiers might be Introduced in line with the Company strategic approach. Tiers are also subject to discontinuation for the same reason.

If a member purchased a membership on a specific tier or price, this tier is associated to the purchased membership and its term only, and not a subject to carry over. At renewal, the latest corresponding Terms and Conditions apply.

Tiers and access define the clubs that are open and operational at the time of membership purchase and do not include clubs that are not opened or operational or might be opened in the future. Thes might be added to the existing tier or a new membership must be purchased through new purchase, renewal or upgrade to gain access to the newly opened or newly added to the portfolio clubs.

Newly opened clubs do not fall under previously purchased memberships and members have the option to upgrade or renew on the new tier that include new clubs.

The tiers mean:

Home Tier: access to your chosen one club of Home Club [branch] of FitnGlam.

Infinite Glam Tier : access to all FitnGlam clubs across UAE that are operational and active at the time of membership purchase.

Signature Fit : access to clubs specified in the Signature Fit portfolio of clubs at the time of membership purchase.

Any other tiers not mentioned above have been discontinued for further purchase, renewal or re-join option and members must choose from current active membership options available at renewal, upgrade or to purchase new subscription.

“Member” shall mean an individual who has been issued an RFID wristband with a unique Membership ID Number by the Company for accessing and using the facilities provided at the Club.

PERSONAL DETAILS

All information provided at the time of registration must be true and correct, the Member shall be solely responsible and liable if said information is found incorrect. The Company reserves its right to terminate a Membership without notice or refund of any Membership Dues if the information provided is found to be incorrect at any point of time. A Member also agrees to provide additional information as and when demanded by the Company. To apply for Membership, photo identification (Emirates ID or passport), are required, in addition to a valid phone number and e-mail address for yourself and a person to be contacted in the case of any emergency.

MEMBERSHIP CATEGORIES

The Company offers several types of Membership and once the applicant chooses a particular type of Membership, she will be entitled to the privileges applicable to the Membership type selected for the specific duration of the term purchased. The different types of Membership will specify the access to facilities and services that are included in the membership purchased.

MEMBERSHIP ENTITLEMENT

  1. The Company is not obliged to accept the online registration of every applicant and shall have the right to reject and/or refund the money paid at the time of applying for Subject to the Company’s approval, Membership entitlement begins immediately from the date as mentioned and or detailed in the MAAF and the acceptance of the Club Rules by the Member, as specified from time to time by the Company. A Member is entitled to access and use the facilities and services of the Club only during the specified operating hours of the specific Club.

  2. You are requested to leave the Club premises punctually at the time of The Clubs’ normal hours of operation are indicated at the Club reception, website, and social media accounts. The Management reserves the right to adjust the hours as they see fit and for the purposes of cleaning, decorating, repairs, and special private functions and holidays. The Management shall endeavor to give reasonable notice of any change in the hours of operation.

  3. Membership is available to an individual who is 16 years of age and above subject to the applicant furnishing a valid document confirming age; acceptance of such document shall be at the sole discretion of the Company.

  4. The Club will start all memberships on the date of A Member may postpone the start date at the discretion of the General Manager; such requests must be made officially in writing and in advance. MEMBERSHIP RFID WRISTBAND AND APP USAGE

  1. On successful application, including acceptance of the Membership Terms & Conditions along with the payment of the requisite Membership dues, the Club shall issue the Member an RFID The RFID wristband shall always remain the property of the Company and is non-transferable.

If any person other than the Member is found in possession of the RFID wristband and using the same in order to access the Club, then the Membership of the Member to whom the RFID wristband was issued shall be immediately terminated without any notice, and/or refund of any Membership dues to the Member; the Membership subscription payable for the balance minimum term by the Member shall stand payable and recoverable by the The trespasser in possession of the RFID wristband shall be asked to leave the Club premises after returning it to the Company and payment of a fee equal to the one (1) day guest pass.   4. When you sign up for Member services using the FitnGlam app or Client Portal, you will be asked to choose a You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify FitnGlam immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for all use of your account.

    MEMBERSHIP DUES, PAYMENT OPTIONS AND RENEWAL

    1. The Membership dues are non-refundable and subject to change without The Member shall be required to pay for the terms of membership they purchase from the available at the time terms, example for six-month (6) and twelve-month (12) upfront Memberships in full in addition to an administration fee, before access and associated benefits to the Club are granted.

    2. The Company reserves the rights to sell any type of term, duration, tier and price of membership they see fit as part of the strategic business decision which remains solely a business decision of the Company.

    3. The Membership terms remain a subject to availability and change and are not permanently available to purchase by new members, re-joining members or renewing members.

    4. On expiry date of the upfront Membership, the Membership will be automatically Renewal rates and options are dictated by the Company and are subject to discontinuation or new rates introduction which the member can choose from at the time of renewing. Previous rates do not automatically apply at renewal; current at the time Club prices and administration fee will be applicable thereafter. All dues must be settled in full to continue accessing the facility. The Company might allow members to keep their previous rate if the membership type or tier is available to renew and the member must renew continuously to keep their rate, any delay will lead to an increase to current rates.

    5. Renewing on the previous rate or same rate as previous membership is not guaranteed as it depends on membership tiers and prices available at the time or renewal and joining.

    6. A Member choosing the monthly option with a specified monthly rolling commitment period is required to pay their Membership Subscription Fee on a recurring month-on-month basis via monthly billing to the bank card provided via automated billing system. Should the payment method chosen by the Member fail, for any reason outside of FitnGlam control, the Member is required to immediately settle all membership dues and indicate an alternative payment method allowing automatic collection of Fees by There will be an additional administration charge for each additional attempt of membership dues collection by FitnGlam, in line with the current price list at the Club.

    7. The Monthly Subscription Fee will be deducted from the original UAE-issued credit card on the 1st day of each month and in the event of failure, the card will be billed subsequently on a schedule until recovery of agreed dues.

    8. The UAE-issued credit card must be in the name of the membership applicant, otherwise, authorization from the cardholder is required.

      1. Default payments will be automatically added to successive billing-runs, they will be subsequently charged until the payment is collected. In such cases access to the club will be denied until the outstanding fees are paid. In the event of a default by the Member in making timely payments, the Membership shall remain suspended for the entire period of the default and such suspension shall be revoked only on the payment of the payable monthly subscription. The club will keep on trying to charge the member’s bank account until the payment is collected. FitnGlam reserves the right to terminate membership agreement to excessive failure to pay fees on time and to defaulters exceeding the period of 60 days. If the member would like to re-join later, she must register with a prepaid membership only on current at the time available rates.

      2. Valued Added Tax (VAT) and other charges levied by the government are included in all prices for memberships, products and services displayed by FitnGlam.

      CANCELLATION AND TERMINATION OF MEMBERSHIP

      1. All monthly-paid Memberships are open-ended and do not have an expiry date; therefore, the Company will continue to deduct Membership dues until a request to cancel is received from the Member, provided that request to cancel is made in accordance with these terms and Memberships paid in instalments do not automatically cancel after the initial minimum term, the termination of the agreement needs to be reported at the clubs front desk in writing , at least, one month prior to the effective date (next month to be considered the last month of dues). In case of the early termination (before the end of commitment period), the Member should provide the confirmation documents (medical reason, leaving the country) to the Club Manager/ CRM Manager during the meeting and pay a one-time cancellation fee.

      2. The cancellation shall not take effect until the Company approves the same in their sole discretion and has received all the Membership dues and cancellation fees, if any.

      3. On receipt of the cancellation fee, the Member shall obtain confirmation in writing from the Club that the termination has been applied.

      4. A Member whose Membership is terminated by the Management shall forfeit all the privileges of Membership with immediate effect without claim of any refund of monthly Membership dues, other than any monthly Membership dues paid in On termination, the Member will be required to return her RFID band and shall settle any outstanding debts. Termination may take place without notice and with immediate effect if:

        i. In the event fees for services such as Personal Training remain unpaid after the due date. Legal action will be taken to recover any outstanding dues from the Member. You may not join any of our Clubs until the outstanding amount is paid.

        ii. A Members’ conduct, whether such conduct is the subject of complaint by another Member or Members, is such that in the reasonable opinion of the Management, it is harmful to the character and/or interests of the Club.

        iii. A Member is rude, aggressive or in any way disrespectful to another Member or to any of the FitnGlam employees, this includes foul and bad language.

        iv. The Company is of the opinion that the Member shall have committed any breach of the Club Rules & Regulations that the Club has in place.

        v. A Member is soliciting and selling private services such as Personal Training or merchandise of any type to any Member or guest as this is strictly prohibited.

        vi. Upon notice in writing, the Company is of the opinion that the Member is not a suitable individual for continued Membership of the Club.

        vii. A Member is found to have violated the privacy of any other Member within the shower and/ or changing rooms or is caught in lewd or compromising actions, this includes ignoring or disrespecting the Clubs’ ‘No Nudity’ policy in the changing room area.

        viii. A Member is found to be smoking (including vape devices and e-cigarettes), drinking alcohol or under the influence of mind-altering substances.

        ix. An attempt is made to bring pets or other animals inside the Club.

        UPGRADE OF MEMBERSHIP

        1.  A Member can upgrade the status of her Membership anytime during the Membership term and she shall be contractually bound by her original minimum contract A new Agreement will apply with the latest Terms and Conditions if a member changes their membership via renewal, upgrade or change of membership.

        2. Downgrades are not permissible during the duration of your contract.

        CHANGE OF HOME CLUB

        1. In the event a Member wishes to change Membership from an existing Home Club to another FitnGlam Club in the UAE, she shall be liable to abide by the Club rules, as specified from time to time, of the new Club.

        2. The Member is also liable to pay the difference in membership subscription if their current Membership type is unavailable in the new The Member will also be charged a non-refundable one-time transfer fee.

        3. Change of Home Club is not permissible with any outstanding dues.

        4. Your home club membership may allow you reciprocal use of any of our FitnGlam clubs depending on type of the membership. Your home club is the club you spend 90% of your time at. If this limit is exceeded your membership will be transferred to that club and subject to the new home club membership prices.

        TRANSFER OF MEMBERSHIP

        A Member can request and apply for the transfer of their Membership to another person if she qualifies to be a Member under the Club rules, as specified from time to time, and agrees to accept the Membership Terms & Conditions. The transferring Member is required to pay a Transfer Fee to the Home Club. In this case the balance minimum term of the transferred Membership will get transferred to the new Member who will need to sign a fresh MAAF and pay the applicable fees. The request for the transfer must be made by the Member in writing to the Home Club and permission for the transfer shall be provided at the sole discretion of the General Manager of the Home Club. Transfer of such a Membership can only be made within the same category and in the case of transfer to another Membership type or category which is at a higher rate at the time, the differential in dues will need to be paid.

        FREEZING OF MEMBERSHIP

        1. To “freeze” a Membership, contact Club Management via the FitnGlam app/ Client Portal or via email. The member must keep the proof of request or ticket number for future correspondence reference.

        2. Seven (7) working days’ minimum notice is required to freeze your Membership for the future date and no backdating for the time passed is allowed.

        3. Freezing is not permitted within the first two months of any Membership.

        4. All members must pay the freeze fee at the time of request; a payment link will be sent to you if required.

        5. The membership end date will be adjusted according to the number of weeks/months equivalent to the frozen period.

        6. For monthly payment plans, subscription fees will not apply for the duration of the freeze period, provided your account is not in default status, a freezing fee will be required.

        7. For prepaid plans, maximum freeze period is 30 days for a six-month
          (6) membership and 60 days for a twelve-month (12) membership. These may be taken in multiples of 15 days only for a maximum of two (2) freeze per six-month (6) and four (4) freezes per twelve-month (12) membership. For upfront memberships freezes can start from 1st or 15th of the month.

        8. For monthly plans, the maximum freeze period is 60 days. Monthly memberships can freeze for full calendar month, with a limit of 2 times in a 12 month period. Membership fees won’t be charged for this period from members card. You cannot use the Club while your Membership is frozen.

        9. All freeze requests are a subject to freeze fee, a complimentary Membership freeze might be considered if includes serious illness, injury and pregnancy if accompanied by a letter or certificate from a medical professional stating exercise is prohibited for a specified period. The maximum period of complimentary freeze is 3 months.

        10. No other circumstance grants a free period for membership to be applied.

        GUESTS AND VISITORS

        1. A non-member may visit the club with a member as “guest” and will be subject to day pass fees applicable at the time.

        2. Members introducing guests shall ensure they complete the visitor register and pay the guest fee to obtain their guest pass.

        3. For security reasons, all guests and visitors are required to provide a photo ID such as Emirates ID or Passport copy when visiting a Club. A copy and/or ID number will be retained on record.

        4. For health and safety purposes, all guests and visitors are required to complete a Physical Activity Readiness Questionnaire (PARQ).

        5. Guest access remains at Management discretion.

        6. A Guest Invitation that has been issued on a ‘complimentary’ basis and linked to an official activation by the Company must be used in line with the stated T&Cs.

        7. Members are not permitted to use a Guest Invitation access to gain access to the Club or use any paid facilities without charge unless authorized by Management.

        8. Guests will have the same Membership privileges as the Member who introduced them and will be subject to the same Club Rules and limitations of liability as the Member. It is the responsibility of the Member introducing a guest to ensure that their guest complies with the Club rules.

        9. The Management reserves the right to exclude any guest from the Club without giving any reason for doing so and change the charges levied for guest passes from time to time.

        REFUND AND EXCHANGE POLICY

        1. The Company shall not be held responsible for changes in the Government laws or regulations, as such FitnGlam is not liable for refunds if the Club’s facilities, services, and operating hours are affected because of the same.
        2. A Member shall not receive any refunds partial or otherwise if they have signed up for Membership during a Club pre-sales period and the Club’s opening has been delayed. As such, the Membership will begin from the day the Club is officially opened.
        3. A Member who makes an upfront payment for any Membership or service is not entitled to any pro-rata refund of any amounts paid by them towards said unused Membership term or service, except where the cause for such termination is not attributable to her.
        4. All retail purchases and sales are final. Once payment is made, there shall be no refunds, in whole or in part, for any reason, including but not limited to dissatisfaction with the product or service, delays in delivery, or any other reasons mentioned herein. If the Company in its sole discretion allows a returns or refunds on retail purchases, the item must be subject for a refund or exchange within 14 days from purchase, the customer must provide the Company with a proof of purchase (receipt), and the item must not have been used , has the original price tag and item tag and has not been tampered with. If a receipt is not presented, the Company in its sole discretion may provide FitnGlam store credit which must be used within the specified time.
        5. The consumer shall not be entitled to refund or exchange retail items in the following cases:
          i. On food and drink or other perishable items unless it can be demonstrated it is not fit for purpose.

          ii. The Item was available elsewhere at a lower price.

          iii. The item was free from any defects. In the event of a defect, the consumer is entitled to the item(s) being repaired or replaced, considering the nature of the product during the warranty period.

          iv. Any refunds, if any, will be credited in the same format as the original payment and can take up to 15 working days to process. We reserve the right to refuse a refund request if we determine that it is not warranted under these terms and conditions.

        HEALTH AND SAFETY

        1. The Member warrants she is in good physical condition and knows of no medical or other reason why she is not capable of engaging in an active or passive exercise programme such exercise would not be detrimental to her health, safety, comfort, or physical condition. A Physical Activity Readiness Questionnaire (PARQ) should be completed upon registration; an updated PARQ is required at least once per calendar year.

        2. Member must abide by our anti-doping policy: this club strictly adheres to the anti- doping policy, which prohibits the use of any banned substances or performance-enhancing drugs as outlined by relevant sporting authorities.

        3. The Member shall not use any Club facilities whilst suffering from any infections or contagious illness, disease, or other ailment such as open cuts, abrasions, open sores, or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort, or physical condition of other Members.

        4. All Members are required to complete the mandatory Welcome Session, before commencing their exercise programme with one of the Club’s Personal Trainers, thereafter any further training sessions can be conducted; Members unsure about any equipment should consult a member of staff.

        5. Trainers are authorized to stop anyone from exercising if in their opinion the Member/guest is exercising in a manner that may result in injury to themselves or others. Users must abide by the guidance of the Trainers.

        6. Members should be considerate of others by using their workout towel when using any of the exercise stations and wipe down equipment with hygienic wipes located throughout the Club.

        7. Members are requested to return all portable equipment to designated areas for safety purposes; it is not permitted to remove said items from any FitnGlam branch.

        8. Members should utilize mobile phones and other devices for communication and/or entertainment purposes using ear/headphones to ensure other patrons are not disturbed or It is forbidden to use a mobile device to take photos or videos with other members, staff or visitors in sight or to be on live video during the time in the Club. These offences are taken very seriously and might result in membership cancellation.

        9. For health and hygiene, Club users are requested to shower before entering the sauna, steam room and solarium.

        10. Members or guests may not use the facilities of the Club whilst under the influence of alcohol, narcotics, or other mood-altering FitnGlam operates a strict no smoking policy, this includes the use of vape devices and e-cigarettes.

        11. For safety and hygiene purposes, eating is not allowed in undesignated areas.

        12. Members must use closed toe gym specific footwear at all times in the Club, unless they are attending an official activity run by the Club where different footwear is permitted or required. Members who wear no shoes will be asked to return wearing sport footwear.

        13. It is the Member’s responsibility to update the Club in writing with any information that might affect their ability to engage safely in physical activity in the Club(s).

        14. Members and their guests exercise and use the facilities at their own risk.

        DRESS CODE

        1. All Members and guests are required to wear proper gym attire when exercising; no denim or clothing with studs or other embellishments that may damage equipment or become a safety hazard are permitted.

        2. Closed toe, non-marking, rubber soled sports shoes are recommended; training in socks or barefoot is not allowed and where a member is performing an exercise in socks or barefoot it is only for the duration of the specific exercise at their own risk.

        3. Members should remain modestly dressed when using the sauna, steam room and changing areas. Nudity is not permitted; Members are requested to use the private changing cubicles provided.

        LOCKER USAGE

        1. Temporary lockers will be provided by the Club at the member direction and must be cleared daily. The Management does not take any responsibility for the items kept in the lockers.

        2. Your RFID band or 4-digit pin must be used to secure your locker; failure to do so risks theft and/ or accidental locking.

        3. Lockers automatically open 15 minutes after the Club closes, all unclaimed items will be logged and stored as lost and found. All lockers should be cleared of items by the member using the chosen locker and no items should be left inside the locker overnight. If that is the case, members it is at the member sole discretion and responsibility.

        4. Unclaimed properties will be kept by the Club as per Lost and Found Policy, after which the Management reserves the right to dispose of the items in any way it sees fit. The Management does not take any responsibility for the items kept in the lockers.

        5. Do not keep any money or valuables in your locker. FitnGlam cannot be held responsible for any loss or damages.

        LOST AND FOUND

        1. Any items claimed to be forgotten or lost by the Member during their visit to any FitnGlam location shall not be the responsibility of the Club. If any items lost are found by the Club, the same shall be retained as follows:

          i. Valuables (including electronics) 3 months.

          ii. Non valuables 2 weeks.

          iii. Perishables and heavily soiled items Discard immediately.

        2. If items are not claimed within these timeframes, the Club retains the right to discard as they see fit. The Company bears no responsibility or liability for the safekeeping and/or custody of any lost items.

        CONDUCT AND USE OF CLUB FACILITIES

        1. The use of mobile phones with camera features and/or any other types of visual recorders and subsequent posting on social media must be used with caution. Images and videos taken must not include other patrons; such instances are considered as a privacy violation and a complaint can be filed against you under the cyber laws act in the UAE for breach of privacy.

        2. Members and guests are not allowed to bring their own food and/or drinks into the Club.

        SERVICES

        The Company may offer additional services at some Clubs inclusive of but not limited to Personal Training, and other special programs and services. These services will incur additional charges and/ or fees and have separate Terms & Conditions. A Member must enter into an agreement for any such additional services provided by the Club, prior to using these services.

        Training Personal and EMS:

        1. Can only be conducted by FitnGlam employed trainers and the officially contractual to the Company freelance trainers.

        2. Can only be purchased by FitnGlam active members.

        3. All conducted sessions must be signed as completed on the day.

        4. All sessions must be completed before or on the contract expiry date, any extension must be authorized by the Fitness Manager after ensuring all relevant documentation and records to support the extension has been received e.g., medical certificate.

        5. The Club reserves the right to provide a replacement Personal Trainer in the event the current trainer is not available.

        6. Sessions must be cancelled at least 24 hours in advance of the scheduled appointment time. Failure to do so or attend a scheduled personal training session without notice will result in the session being fully charged.

        7. All personal training sessions purchased are non-refundable and non-transferable.

        8. Personal Training sessions can be booked at reception, with Personal Trainer, through the Mobile App or Client Portal.

        Group Exercise Classes

        1. Advanced booking is required via the FitnGlam app or Client Portal.

        2. FitnGlam offers specialized classes such as Reformer Pilates / Skill X / Cross Fit classes that are available as specialized classes and corresponding membership or a dedicated package must be purchased in addition to the membership to gain access to these services, subject to the branch’s specialty.

        3. Bookings are open in line with the full Class Booking policy available In the
          Booking application.

        4. Arrival 15 minutes before the start of class is required for first-time attendees of all programmes for health and safety purposes.

        5. Members and guests are not allowed to enter the studio once the class has started. FitnGlam has a strict no late entry policy. Please arrive ahead of time to allow time to check in and prepare for the class; individuals failing to arrive on time will be denied entry and the class will be marked as a no show.

        6. Penalties apply for no show and late cancellation; no show indicates not arriving or late arrival to a booked class and late cancellation indicates cancelling a class less than 12 hours before the start time.

        7. Members are asked to refrain from using mobile phones in classes; photography and videography in classes is prohibited.

        8. Members are asked to use appropriate closed toe, non-marking, rubber soled sports shoes when participating in all classes, except for those held in the Mind Body studios.

        9. Specialised classes will be offered at an extra fee and will be advertised accordingly.

        10. Group exercise classes are available to Members with Gym & Classes subscriptions and clients with active class packages.

        11. Members must not use the studios unless permission has been granted from the Fitness Manager or General Manager.

        Solarium:

        1. Clients use the tanning machine at their own risk.

        2. Tanning services are available to those aged 18 years old and above only.

        3. All minutes and packages purchased are non-refundable, non-transferrable and must be used within the validity period.

        4. We recommend leaving 48 hours between sessions.

        5. It is required for the client to wear eye protection/goggles during tanning sessions.

        6. Avoid tanning sessions when taking medications that can increase your sensitivity to UV light and therefore might cause sunburn. Some of these medications include but are not limited to antibiotics, anti-depressants, diuretics, and blood pressure medicine.

        7. Do not wear cosmetics such as perfume, make-up, and deodorant before a tanning session. It is common that these cosmetics increase the sensitivity of your skin and can also increase the chance of sunburn.

        PROMOTIONS AND ACTIVATIONS

        Members participating in any activations or promotions agrees to the Terms and Conditions applicable to those. Member has the option not to participate and purchase items and services that do not fall under the activation or promotion.

        1. One person. per entry or voucher Where voucher applies.

        2. Offers cannot be combined.

        3. You must present the voucher to be eligible for promotion redemption.

        4. Lost vouchers will not be replaced, only original vouchers are valid.

        5. You must follow the redemption rules stated on the voucher.

        6. Not redeemable for cash and not exchangeable.

        7. Membership must be valid/active and clear of arrears at the time of voucher usage.

        8. Voucher redemption remains subject to Management discretion.

        INTELLECTUAL PROPERTY AND TRADEMARK

        1. All brandings, designs, logos, and Club interiors follow the FitnGlam Brand Manual. Members and/or guests are not allowed to photograph or copy any Club interior designs, promotional materials, tag lines, themes, or concepts. FitnGlam reserves the right to proceed with legal action to any Member caught distributing, sharing, or supplying such content to any third-party vendor or competitor.

        2. The content on the FitnGlam website and app, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features, and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to FitnGlam, subject to copyright and other intellectual property rights under the law. Content on the website is provided to you as is for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.

        3. The Company website may contain links to third-party sites that are not owned or controlled by FitnGlam.

        MOBILE SERVICES

        FitnGlam Services may include certain services that may be available via your mobile phone, including but not limited to:

        1. Booking and/or purchasing FitnGlam services and products via your mobile phone.

        2. Receiving and replying to FitnGlam messages.

        3. Browsing FitnGlam from your mobile phone.

        4. Accessing certain FitnGlam features through a mobile app you have downloaded and installed on your mobile phone. We do not charge for these Mobile Services. However, your carriers normal messaging, data and other rates and fees will still apply. You should check with your carrier to find out what plans are available and how much they cost. In addition, downloading, installing, or using certain mobile services may be prohibited or restricted by your carrier, and not all mobile services may work with all carriers or devices. Therefore, you should check with your carrier to find out if the services are available for your mobile device(s), and what restrictions, if any, apply. By using the mobile services, you agree that the Company may communicate with you regarding FitnGlam and other entities by SMS, MMS, text message, push notifications or other electronic means to your mobile device; certain information about your usage of services may be communicated to us.

        COMPLAINT/GRIEVANCE OR FEEDBACK

        1. The Company shall always endeavour to provide the required facilities and services at its Clubs, however, in case of any complaint/grievance or feedback received in writing at front desk of the Home Club or via email with respect to the facilities and services provided to a Member, the Club Management shall endeavour to contact Members and guests within seven (7) working days and address the complaint/grievance or feedback.

        2. Defamatory remarks made on social media or by any other electronic means (including WhatsApp, websites, SMS, and email) regarding the Company, Club and/ or Club Staff may be an offence under Federal Law No. 5 of 2012 (the “Cyber Crime Law”). Such acts will be taken seriously by FitnGlam within the fullest extent of the law.

        CHANGE OF RULES AND FACILITIES & SERVICES

        1. The Company may, at its sole discretion, add, remove, or amend the Club rules, including but not limited to the operating hours and the services and facilities provided by the Club due to regulatory, administrative and/or commercial compulsion or for any other reason considered necessary by the Company.
          Where a Swimming Pool , Sauna, Steam, Cold Plunge or any other additional club services and facilities form part of the services, specific Terms and Conditions of use and access apply. These are inclusive of the Membership Application & Agreement Form (MAAF) and in addition to MAAF.

        2. Any such additions, deletions or changes from time-to-time will be notified to all Members through a medium as the Company feels appropriate by a notice of five (5) days, except for emergencies.

        3. The Company reserves the right to suspend the operation of any branch for the purpose of repair and maintenance of the Club(s) without any Membership rebate for a period which shall not exceed one (1) day and if at any time such period exceeds beyond three (3) days, the Club may, by written notice, communicate the transfer of their Membership to another Club, or grant the Member with a complimentary time freeze for the said period.

        4. By agreeing to this Terms and Conditions document, the Member acknowledges and consents that each Club will provide certain services that could be unique to that location. The Member also agrees to release the Company from all liability if any or all services are reduced, modified, suspended, or eliminated due to external factors. Should a Member choose to cancel her Membership due to the modification, suspension, or termination of said services, the standard cancellation policy shall apply. The Member also agrees not to seek compensation for the elimination, reduction, or suspension of any services, either monetary or in services rendered in lieu of.

        VERBAL AGREEMENT AND WAIVER

        These Terms and Conditions can only be varied in writing signed by an authorized representative of the Company, and they override any verbal or by-conduct agreements. The Company shall not honor or entertain any verbal or by-conduct agreements that are claimed by the Member to have been made by any Club Staff or Club Management that are contrary to the Club rules, as specified from time to time.

        LIMITATION OF LIABILITY

        In consideration of being allowed to access the Club and participate in the activities provided at the Club or at any location outside the Club, the Member hereby undertakes and declares that the Company and Club Staff are fully absolved of any or all liability. This includes from any injury or damage caused (whether fatal or otherwise) to her or any loss, damage or theft of any property belonging to, or brought into the Club premises by a Member or any guest occurring within the Club howsoever caused and that the Company/ Club’s contractual and legal rights and remedies, are independent and cumulative.
        Any Club surrounding areas or facilities that are not under the direct management of FitnGlam, do not fall under FitnGlam responsibility and the Company accepts no liability for any injury or loss incurred through use of these facilities.

        RELEASE AND INDEMNITY

        FitnGlam, its associated companies, employees or agents shall not be responsible for any claims, demands, injuries, damages, or actions for negligence arising on account of death or due to injury, loss, damage, or theft to Member’s personal property arising out of or in connection with the use by a Member of any of the services, facilities on the premises of FitnGlam. The Member hereby holds the Company, its associated companies, employees, and agents harmless from all claims which may be brought against them by or on a Member’s behalf for any such injuries or claims aforesaid.
